City of Porterville Charter Amendment, Measure R (June 2010)

According to an impartial analysis of Measure R prepared by the city's attorney:
|“||Measure R will amend Section 68 of the city's charter. It will eliminate the requirement that Porterville's contracts include language that allows the City to terminate any lease at its pleasure with 3 months notice in all leases of City property. The amendment also adjusts the allowed long term lease period from 50 to 55 years, as otherwise allowed for cities following general applicable municipal law. Finally, the amendment permits leases for up to 99 years on the condition that the lease provides for periodic review in light of market conditions, and lease is established by ordinance of the City Council, after a noticed public hearing, therefore making the lease subject to referendum by the voters. The lease eliminates the explicit language concerning payment of fair market value for the lease/tenant-owned improvements in the event of termination prior to the conclusion of a lease term; however the City is required to pay fair market compensation and provide other remedies in accordance and by operation of State law.||”|
