Mark H. Brain is a judge on the Maricopa County Superior Court in Arizona. He was appointed in March 2011 by Governor Jan Brewer.[1] He was retained on November 4, 2014, for a term that expires on January 6, 2019.[2][3]

Brain was retained to the Maricopa County Superior Court with 70.4 percent of the vote on November 4, 2014.[3][4]


The Judicial Performance Review Commission provides Arizona voters with an evaluation of each judge up for retention. The commission votes on whether a candidate meets or does not meet the JPR standards. Each judge is assessed on their legal ability, integrity, communication skills, judicial temperament and administrative performance.[5]

The commission voted that Brain met the JPR standards. The vote was 29-0 in favor of retention.[3]


Brain received his undergraduate degree in physics in 1985 from Iowa State University and his J.D. from the University of Michigan School of Law in 1988.[1]


Judicial philosophy

The press release announcing the appointment stated, "Commissioner Brain is reflective of Governor Brewer’s continued effort to identify and appoint judges who share her philosophy that judges should strictly interpret and apply the laws as written."[1]
