Texas House of Representatives2012 Texas Senate Elections
Elections for the office of Texas House of Representatives consisted of a Primary Election on May 29, 2012 and a General Election on November 6, 2012. The Primary Runoff Election took place on July 31, 2012.[1]

The signature-filing deadline for candidates wishing to run in these elections was March 9, 2012.[2]

* Redistricting note: Due to legal turmoil in the redistricting process, the primary date changed twice. The original filing deadline was December 12th.[3][4] That deadline was then moved to December 15th by a federal court due to delays caused by redistricting legal challenges. After the US Supreme Court intervened over the constitutionality of interim maps, the current December 19th deadline was set to allow candidates more time in filing in light of the delays. The original primary date was March 6, 2012 and the original primary runoff date was set for May 22, 2012.

Impact of redistricting

With the Republican-controlled legislature's approved maps held up by lawsuits mostly concerned with the Voting Rights Act and minority population growth, Texas' legislative redistricting process remained heavily contentious into 2012, leaving the state to use a set of interim maps released in February by a San Antonio federal court. This was the second set of such plans, as the first had been struck down by the U.S. Supreme Court in January for not being true to the original maps from the Legislature. The primary was moved back twice, finally happening on May 29. According to the Associated Press, Republicans were expected to win 85 House seats, Democrats 50, with 15 being competitive.[4]

Qualifications

To be eligible to serve in the Texas House of Representatives, a candidate must be:[7]

  • A U.S. citizen
  • 21 years old before the general election
  • A two-year resident of Texas before the general election
  • A district resident for 1 year prior to the general election

If there is a vacancy in the House, the Governor must call a special election to fill the vacant seat[8]. A Governor's proclamation to a special election must be delivered to local elections authorities representing the vacant seat no later than 36 days before the scheduled election[9].

The Secretary of State can declare a candidate duly elected in a special election if there is no opposition[10].
