Background

This measure enacted an ordinance allowing the sale of the village water system. Village officials, unsure of how the sale would be enacted, tried to appeal the measure. The Ohio Secretary of State was the entity that made the final decision on whether or not the measure could be appealed.[2] The issue had passed through the court of common pleas, without changes being made to the language of the petition.[3]

Proponents of the measure saw the water system as a waste of village money. Village officials were trying to ensure that the village would retain adequate water usage rights.[4]
