Mission Statement
The mission of the Alaska Public Offices Commission is to encourage the public's confidence in their elected and appointed officials by administering Alaska's disclosure statutes and publishing financial information regarding the activities of election campaigns, public officials, lobbyists and lobbyist employers[1].
History
The Alaska Public Offices Commission was formed in 1974 after a successful citizen initiated referendum that created the commission. The citizen initiative came in response to the Watergate scandal that year[2]. The Alaska Public Offices Commission was formerly called the Alaska Election Campaign Commission until 1976 when the Legislature expanded the Commission's responsibilities to include the ethical affairs of elected officials[2].
Governance
The Alaska Public Offices Commission is governed by a five person board[3].
Campaign finance discipline
If a person feels that a individual or committee violated Alaska campaign finance law, the first step is to file a complaint with the Alaska Public Offices Commission within five years of when the alleged incident happened[4]. The Commission has 90 days after the complaint is filed to take any and necessary action unless the person receiving the complaint wants to expedite the complaint process[5] [6]. All expedited complaints must be heard by the Commission within 2 days of granting such consideration[7].
For all regular complaints, the matter must be heard within 45 days after the written response from the person receiving the complaint is due[8]. If someone is found guilty of violating Alaska campaign finance law, the Commission can levy civil penalties including monetary fines[8] [9]. Any complaint that involves the constitutionality of Alaska law or is not in the jurisdiction's matter, the Alaska Attorney General is responsible for handling the complaint[10].
