Campbell v. Buckley
The unsuccessful lawsuit was a challenge, under federal law, to the constitutionality of a then-recent addition to laws governing the initiative process in Colorado, namely, the addition of a state board that determined the ballot title for an initiative.
The plaintiffs were Douglas Campbell, Richard Hamilton, Clyde Harkins, Jack Hawkins, Daniel Hayes, Gary Swing, Jeffrey Wright, Douglas Bruce, the Initiative & Referendum Institute, Americans for Sound Public Policy and the American Constitutional Law Foundation.
The defendants were Victoria Buckley, in her official capacity as Colorado Secretary of State, the Colorado Initiative Title Setting Review Board, and Richard Westfall and Rebecca Lennahan, in their official capacities as members of the CIRTSB.
