- Privacy/ID Theft: "Senator Fuschillo sponsored a landmark law to safeguard people’s privacy and protect them from identity theft, one of the fastest growing crimes in the country. He authored the law requiring businesses and government agencies to notify consumers when their personal information is compromised as a result of a security breach. Senator Fuschillo also wrote the law allowing consumers to block outside access to their credit information by placing a security freeze on their credit reports. "
- Job Creation: "To create jobs and enhance New York State’s economy, Senator Fuschillo helped develop the Broad Hollow Bioscience Park at Farmingdale State College, which serves as a home to established and startup biotechnology companies."
- Consumer Protection: "To help further protect consumers, Senator Fuschillo authored New York State's Telemarketer 'Do Not Call' Registry law, and also sponsored the law which raised the maximum fine for price gouging to $25,000 per violation. "
- Public Safety: "In the battle to combat drunk driving in New York State, Senator Fuschillo has been leading the fight. He authored some of the most sweeping drunk driving reforms of the last quarter century in New York State. He sponsored laws which lowered New York State's legal blood alcohol content (BAC) level from .10 to .08; enacted tougher penalties for repeat offenders and those who drive with an elevated BAC; and expanded the use of ignition interlock devices to keep convicted DWI offenders from drinking and driving again."
- Public Health: "To protect the public health, Senator Fuschillo wrote the law to amend the New York State Clean Indoor Air Act, which made worksites and public places smoke free. The State has experienced a significant reduction in non-smokers’ exposure to second hand smoke since the law was enacted in 2003."

He ran unopposed in the Republican primary on September 13, 2012; he also ran on the Conservative Party and Independence Party tickets. Fuschillo defeated Carol Gordon (D) in the general election which took place on November 6, 2012.[2]
