Mitchell won election in the 2012 election for Arizona House of Representatives District 13. He and incumbent Steve Montenegro defeated incumbent Russ Jones in the August 28, 2012, Republican primary. He won the general election on November 6, 2012.[2][3]

Residency challenges

Mitchell's residency was at the heart of a legal challenge launched in September 2012 when Rep. Russ Jones, who lost to Mitchell in the August primary election, argued Mitchell should be removed from the ballot because he lives outside District 13.[4]

On September 21, 2012 the Arizona Supreme Court reinstated Mitchell's name appearing on the ballot.[4] He allegedly gave elections officials different addresses on different documents prompting a Maricopa County Superior Court judge to determine that he lived outside District 13, leading to an emergency request to the state Court of Appeals to block the trial court decision.[4] The Arizona Supreme Court decision denied the request to reverse the Appeals Court ruling, guaranteeing that Mitchell will appear on the general election ballot.[4]
