Eberly was defeated by incumbent Bob Latta.[2] Eberly ran in the 2012 election for the U.S. House, representing Ohio's 5th District. The signature filing deadline for candidates wishing to run was December 7, 2011. Eberly ran unopposed in the March 6, 2012 Libertarian primary, and will face incumbent Rep. Bob Latta (R) and Angela Zimmann (D) on November 6, 2012.

The Washington Post listed the House of Representatives elections in Ohio in 2012 as one of the states that could determine whether Democrats retake the House or Republican holds its majority in 2013.[3] Ohio tied with Pennsylvania for 9th on the list.[3]
