A Fairfax City Use Tax Implementation measure was on the August 7, 2012 ballot in the city of Fairfax, which is in Atchison County.

This measure was approved

  • YES 79 Approveda
  • NO 76[1]

This measure sought to implement a use tax set at a rate of 1 percent on goods purchased out of state. The rate is the same as the current sales tax in the city. In January, 2012, the Missouri Supreme Court had ruled that the current use tax was unconstitutional and because the state legislature failed to pass a new tax the choice was left up to the local authorities if they wanted to implement their own use tax. City officials had stated that this would not be a new tax, it would be at the same rate as the previous use tax.[2]
