Valentine filed to run in the 2012 election for New York State Senate District 38. He filed to run against incumbent David Carlucci -- who is also running on the Working Families Party and Independence Party of New York State tickets -- in the Democratic primary on September 13, 2012. Janis A. Castaldi is running in the Republican primary. The general election took place on November 6, 2012.

However, Carlucci challenged Valentine's petitions, ultimately getting him removed from the ballot. On August 7, 2012, the New York State Board of Elections ruled that 732 of Valentine's 1,591 signatures were invalid.[1]
