Hayes ran in the 2012 election for North Carolina House of Representatives District 4. He ran unopposed in the Libertarian primary on May 8. He was defeated by incumbent Jimmy Dixon (R) in the general election which took place on November 6, 2012.[1]

Campaign themes
Education: "North Carolina should never infringe on the parents’ right to educate their own children in the method they see best and to that end must work to protect school choice. As your representative, I would work to ensure that parents who choose to educate their children outside of the public school system receive equitable tax relief."[2]
Gun Rights: "I firmly believe in the individual’s right to keep and bear arms as guaranteed by the North Carolina State Constitution in Article I Section 30 and the Second Amendment to the United States Constitution. The right to keep and bear arms has multiple purposes, and it is not purely limited to hunting or sport. To the contrary, our founding fathers saw the need for each citizen to be free to bear arms to protect his liberty from an overreaching government.[2]
Individual Liberty and the Constitution: "The founders and framers of both our national and state Constitutions gave these documents not as guides but as chains to bind government, to ensure that its power only extended to those areas specifically outlined in its text. James Madison said it best when he stated, “If men were angels, no government would be necessary,” as he recognized the tendency of men to aggregate power and encroach on the liberty of the people, therefore necessitating a Constitution to bind government. As your representative, I would take each bill, compare it to the authority given to the General Assembly under the United States and North Carolina State Constitutions, and then consider the impact that legislation may have on the liberty of the people as individuals."[2]
