Kirkwood Smoking Ban Measure, 2009
The measure proposed a ban on smoking within the city, however, the measure does note include: private homes, private vehicles, outdoors, 20% of hotel and motel rooms designated for smoking, private clubs established before March 1, 2009 and retail tobacco stores.[1]

Background
A similar measure was also placed on the November 3 which covers all of St. Louis County. However, when it comes to public safety issues St. Louis county is entitled to enact laws that override local laws. Therefore, despite the November results for the Kirkwood Smoking Ban Measure the county result for the St. Louis Smoking Ban Measure would take precedence.[2] However, the Kirkwood smoking ban was more restrictive than the county wide ban, therefore since both passed both bans were implemented. The two bans were not conflicting, a clause in the county wide ban states that if individual cities want to implement stricter rules than what the county implements they are allowed to do so.[3]
In 2006, Kirkwood voters defeated a measure that proposed imposing a smoking ban on public places throughout the city.[4]
