Primary: Maryland has a closed primary system, in which the selection of a party's candidates in an election is limited to registered party members.
Voter registration: Voters had to register to vote in the primary by March 13. For the general election, the voter registration deadline was October 16.[2]

Incumbent: Heading into the election the incumbent is Chris Van Hollen (D), who was first elected in 2002. According to news reports, if U.S. Senator Ben Cardin had not sought re-election in 2012, Van Hollen might have instead run for U.S. Senate instead of re-election to the House.
This was the first election using new district maps based on 2010 Census data. Maryland's 8th congressional district encompassed parts of Carroll, Frederick, and Montgomery counties.[3]

The redrawn 8th district included parts of Carroll, Frederick, and Montgomery counties.[13]
The new district is composed of the following percentages of voters of the old congressional districts.[14][15]
- 6 percent from the 4th congressional district
- 34 percent from the 6th congressional district
- 59 percent from the 8th congressional district

FairVote's Monopoly Politics 2012 study

In 2012, FairVote did a study on partisanship in the congressional districts, giving each a percentage ranking (D/R) based on the new 2012 maps and comparing that to the old 2010 maps. Maryland's 8th District became less Democratic because of redistricting.[16]

- 2010: 71D / 29R
Cook Political Report's PVI
In 2012, Cook Political Report released its updated figures on the Partisan Voter Index, which measures each congressional district's partisanship relative to the rest of the country. Maryland's 8th congressional district has a PVI of D+10, which is the 104th most Democratic district in the country. In 2008, this district was won by Barack Obama (D), 64-36 percent over John McCain (R). In 2004, John Kerry (D) won the district 59-41 percent over George W. Bush (R).[17]

2010
On November 2, 2010, Van Hollen won re-election to the United States House of Representatives. He defeated Michael Lee Philips (R), Mark Grannis (L), and Fred Nordhorn (C) in the general election.[19]
