Gatto earned his BA in History from the University of California Los Angeles in 1996. He went on to receive his JD from Loyola Law School in 2004.

Direct democracy
Gatto is the sponsor of ACA 6, a proposed constitutional amendment that would require that if a statewide ballot initiative would require the state government to spend money, the initiative would have to identify the source of that money.[2]
Proposition 25
After John Chiang, the Democratic California Controller announced on June 22, 2011 that he would be docking state legislative pay because the California State Legislature failed to pass a balanced budget by the deadline of June 15, Gatto was angered and said, "John Chiang just wants to sit there and beat up on the unpopular kids. I now have to explain to my wife and daughter that we won't be able to pay the bills because a politician chose to grandstand at our expense."[3]

2010
Gatto won a special election on June 8, 2010 to fill the unexpired term of Paul Krekorian, defeating Sunder Ramani (R). Gatto and Ramani appeared on the ballot twice, seeking their party primaries. Both candidates won their primaries, setting up a rematch in the general election on November 2.[5]
Incumbent Gatto defeated Republican Sunder Ramani in the November 2 general election.[6]
