Mission Statement
The Election Law Enforcement Commission (ELEC) is dedicated to administering The New Jersey Campaign Contributions and Expenditures Reporting Act, The Gubernatorial, Legislative Disclosure Statement Act, Legislative and Governmental Process Activities Disclosure Act, and various portions of the Uniform Recall Election Law[1].
History
The New Jersey Election Law Enforcement Commission was created in 1973 on an act of the New Jersey Legislature[2] [3].
Governance
The New Jersey ELEC is governed by a four person board.[4].
Selection of members
Members of the board that governs the New Jersey Election Law Enforcement Commission are nominated by the Governor of New Jersey[5]. All members nominated to the ELEC are subject to advise and consent of the New Jersey Senate through a confirmation process. All members serve staggered three year terms[6].
Campaign finance discipline
If someone feels a person or committee violated New Jersey campaign finance laws, the first step is to file a complaint with the New Jersey Election Law Enforcement Commission[7].
It is up to the ELEC to verify[8] and investigate the complaints and to hold any necessary hearings[9].
If someone is found guilty of a campaign finance law violation in New Jersey, the ELEC imposes in most cases a monetary fine [10]. All criminal violations and matters outside of the jurisdiction of the ELEC is referred to the prosecuting attorney in the county where the offense happened or to the New Jersey Attorney General[11].
