During the 2013 session, the North Dakota State Legislature changed the name of the Department to the North Dakota Department of Labor and Human Rights. The change becomes effective August 1, 2013.[1]
Current officeholder
The current officeholder is Tony Weiler. He was appointed in September 2010.
Authority
The department of labor was established in 1965 by an act of the legislative assembly.[2]
Qualifications
There are no specific qualifications for this office.
Appointments
When the position was first created, the labor commissioner was elected on the no-party ballot to a term of four years. Beginning January 1, 1999, the commissioner is appointed by and serves as the pleasure of the governor.
Vacancies
In the event of a vacancy in the office of director, the governor may appoint a new commissioner.
Duties
The duties of the commissioner are outlined in Chapter 34-05 of the North Dakota Century Code:
- improve working and living conditions of employees
- advance opportunities for profitable employment
- foster, promote, and develop the welfare of both wage earners and industries
- cooperate with other state agencies to expand existing industries and develop new industries
- provide information about labor, employee/employer relations, hours of labor, and working conditions
- report biennially to the governor and legislative assembly[3]
Divisions
There are two divisions within the department of labor:
- The Wage and Hour Division is responsible for monitoring labor standards. The staff enforces laws pertaining to minimum wage, overtime, breaks, and youth employment, and also attempts to resolve wage disputes. The department of labot has the authority to collect unpaid waters from employers on behalf of workers.
- The Human Rights Division enforces the North Dakota Human Rights Act and the North Dakota Housing Discrimination Act. The staff investigates complaints of discrimination in the workplace, housing, public service, public accommodations, and credit transactions.[2][[3]

The budget for the Office of the Labor Commissioner in Fiscal Year 2011-2013 was $1,964,636.[4]
