Ballot text legality
After an initiative has been filed with the state secretary of state, the attorney general will review the ballot for legal correctness. Within 5 business days the attorney general must, in writing, notify the secretary of state, the President Pro Tempore of the Oklahoma Senate and the Speaker of the Oklahoma House of Representatives whether or not the proposed ballot tile complies with applicable laws. If any defects are found, the attorney general shall state them specifically and within 10 business days a corrected one may be resubmitted.
Then the attorney general will approve of a ballot title and will send certification that all the requirements have been met to the State Election Board.
- If the proponents of the measure do not approve of the new language or ballot title they may contest it in court.
Enforcing petition laws
If the secretary of state finds any signature violations or other areas of a petition drive that do not follow Oklahoma laws or the Oklahoma Constitution, he turns the matter over to the attorney general.
