Ballot summary
The ballot title read as follows:[1]
Increases state's existing fiscal obligations by shifting costs of incarcerating felons from counties to state.
Result of "Yes" Vote: "Yes" vote requires all felony incarceration, including pre-sentencing incarceration, to be served in state-funded facility; shifts costs from counties to state for incarcerating felons.
Result of "No" Vote: "No" vote retains current law: county provides, pays for pre-sentencing incarceration and felony incarceration of less than one year; state payes costs of longer incarcerations.
Summary: Currently, people incarcerated while waiting, sentencing on criminal convictions remain in county jail, at county expense, until sentencing is complete. A person who is sentenced to more than one year of incarceration is generally transferred to a state correctional facility; any incarceration of one year or less is generally served in county jail, at the county's expense, whether the result of felony or misdemeanor conviction. Measure requires state to pay all costs associated with incarcerating felons; state to reimburse counties for costs associated with pre-sentencing incarceration of felons. Requires post-sentencing incarcerations for felony convictions be served in facilities funded by Oregon Department of Corrections (DOC). DOC may rent jail space from counties, as needed. Measure does not provide revenue source for additional expenditures. Other provisions.

According to the secretary of state, supporters did not file signatures in an attempt to qualify the measure for the 2010 ballot. Initiative petitions for statutes required six percent of 1,379,475, or 82,769 signatures. The deadline for filing signatures for the November 2, 2010 ballot was July 2, 2010.
