Hermanson refused to take Project Vote Smart's 2008 Political Courage Test. The test, which is administered to all candidates for presidential, congressional, gubernatorial, and state legislative offices, asks one central question - "Are you willing to tell citizens your positions on the issues you will most likely face on their behalf?"[2]

Hermanson won re-election to the 96th District seat against Brandon Whipple (D). Hermanson had no opposition in the GOP primary. The general election took place on November 2, 2010.[7]

DUI conviction
On May 26, 2010, Hermanson was found guilty of DUI resulting from a November 2009 accident in Wichita. He pleaded no contest. On July 8, he was sentenced to one-year probation from a six-month jail term for driving under the influence of prescription drugs. Additionally, was ordered to pay a $500 fine and court costs.[13]
