Authority
The department of environmental management, with the director of environmental management as its head, is established in Section 42-17.1-1 of the Rhode Island general laws.
§ 42-17.1-1:
| There is hereby established within the executive branch of the state government a department of environmental management. The head of the department shall be the director of environmental management, who shall be in the unclassified service and who shall be appointed by the governor, with the advice and consent of the senate, and shall serve at the pleasure of the governor. |
Appointments
The director of environmental management is appointed by the governor at the January session following his or her election to office. The state senate must act on the appointment (by either confirming or rejecting the appointee) within 60 days of receiving notice of the appointment from the governor.[1] The director serves as the pleasure of the governor.
Vacancies
According to Title 42 of the Rhode Island general laws, any vacancy in the office shall be filled by gubernatorial appointment. If the state senate is in session, the person may not serve for more than 10 days without senate approval. If the vacancy occurs during a recess, the appointee serves until the next legislative session begins and their name must be submitted to the senate for approval within 3 days of the legislature reconvening.[2]
Duties
The department is responsible for "preserving the quality of Rhode Island's environment, maintaining the health and safety of its residents, and protecting the natural systems upon which life depends."[3] The director has statutory authority over agriculture and conservation, parks and recreation, harbors and rivers, and public health.
The specific duties of the director are outlined in Title 42 of the Rhode Island general laws:[4]
- supervise and control the protection, development, planning, and utilization of the natural resources of the state, such resources, including but not limited to, water, plants, trees, soil, clay, sand, gravel, rocks and other minerals, air, mammals, birds, reptiles, amphibians, fish, shellfish, and other forms of aquatic, insect, and animal life;
- cooperate with the following boards and commission:
- the Rhode Island economic development corporation
- local conservation commissions
- the water resources board
- the solid waste management commissions
- provide for the maintenance of waterways and boating facilities
- establish minimum standards relating to the location, design, construction and maintenance of all sewage disposal systems
- enforce the standards for the quality of air and water, sewage, environmental standards, and hazardous waste
