Robert Edward "N.J. Weedman" Forchion, Jr. was a 2014 Legalize Marijuana Party candidate seeking election to the U.S. House to represent the 3rd Congressional District of New Jersey.

Forchion was previously a 2012 Independent candidate who sought election to the U.S. House to represent the 3rd Congressional District of New Jersey.[1] He lost to incumbent Jon Runyan.[2]

Forchion planned to run in the 2014 election for the U.S. House to represent New Jersey's 3rd District. Forchion was removed from the general election ballot and fought back by bringing his case to appellate court.[3]

Petition controversy

Forchion's name was struck from the ballot by an administrative law judge after the New Jersey Democratic State Committee argued that only 97 of Forchion's 200 signatures were valid, and he needed 100 in order to get on the ballot. Forchion brought the case to appellate court, and the court ordered that they would dismiss the case on August 4, 2014, if Forchion did not "produce transcripts from a 15-hour administrative law hearing," which would cost him at least $3,500. Forchion subsequently began fundraising for the money to pay for the transcripts.[4]

Forchion's challenge of the court's decision was based on four main arguments:[5]

  • (1) he does have 100 valid signatures;
  • (2) if he doesn’t, it is because election officials gave him a map of the district that had errors in it;
  • (3) regardless of all that, the law says challenges are due four days after the petition is submitted, but the Democratic Party official who challenged his petition didn’t object until six days;
  • (4) furthermore the challenge was faxed, and that is not a permissible means for a challenge to be filed.
