Across the nation, special elections are frequently conducted to fill vacancies in state legislatures. 27 states use special elections to fill legislative vacancies. In two states, Illinois and Indiana, special elections are used in limited circumstances. As of May 2013, 48 special elections (not including runoffs) have been scheduled in 20 states. Since these elections are intended to fill unexpected vacancies, more will be scheduled as new vacancies arise.

California State Senate District 32
Gloria Negrete McLeod (D) was elected to the 35th Congressional District of California on November 6, 2012. A special election to fill the vacancy has been scheduled for March 12, 2013. Because no candidate received 50 percent of the vote the top two vote-getters - Norma Torres (D) and Paul Leon (R) - met in a runoff election on May 14, which Torres won.[1][2][3][4][5]

California Senate District 4 | |

Doug LaMalfa (R) announced on August 31, 2012 that he would resign his District 4 seat in the California State Senate after the legislature concluded its 2012 session. LaMalfa, who ran for U.S. House of Representatives, decided to resign early so that a special primary could be consolidated with the 2012 general election. On September 5, 2012, Gov. Jerry Brown (D) announced the special election would take place January 8, 2013, with the primary on November 6, 2012.[1][2] Jim Nielsen (R) initially looked to have won the blanket primary outright, but final returns showed him just short of the 50 percent plus one necessary to avoid a general election.[3][4] Nielsen easily won the special election.[5]

Georgia State Senate District 11 | |

John Bulloch (R) resigned his District 11 seat in the Georgia State Senate on December 6, 2012. While he did not initially provide a reason, Bulloch had been hospitalized with meningitis the previous October. Bulloch was re-elected on November 6, 2012 unopposed. The election took place on January 8, 2013.[8][9] As no candidate won more than 51 percent in the election, the top two vote-getters, Burke and Keown, headed to a runoff on February 5.[10]

Georgia House of Representatives District 21 | |

State Rep. Sean Jerguson (R) ran for the District 21 state senate seat left vacant when Chip Rogers (R) resigned in December 2012. Once his candidacy was certified, Jerguson had to resign his seat in the House in order to run for the senate. A special election for Jerguson's seat took place on January 8, 2013.[19][13][20] As no candidate took more than 51 percent of the vote, a runoff between the top two vote-getters, Laurens and Turner, took place on February 5.[21]

Mississippi House of Representatives District 59 | |

Kevin McGee (R) resigned his District 59 seat in the Mississippi House of Representatives on November 19, 2012, following his criminal prosecution in an ethics case over public contracts that went to his family's company. McGee agreed to pay a $10,000 fine to resolve the case. A special election to fill the vacancy was held on January 8, 2013. Candidates had until December 10, 2012 to file. Special elections in Mississippi are non-partisan. Brent Powell won more than 51 percent of the vote to take the seat, avoiding a runoff.[22][23][24]

| Ben Brooks (R) was elected as as a circuit judge in Mobile County on November 6, 2012. Once he was sworn into the new position a special election had to be held to fill the vacancy. A special primary was scheduled for January 29, 2013. Candidates had until December 13, 2012 to file. Since no Democrats filed, the primary became the general election. A runoff between the top two vote-getters, Jim Barton and Bill Hightower, will take place March 12.[37][38][39]
Candidate Matranga criticized the influence of special interests in the race. As of January 14, the candidates had the following funds in their campaign accounts:[40]
- Barton: $218,000
- Hightower: $30,000
- Matranga: $2,800
If Barton wins the seat, a special election will be called for his seat in the Alabama House of Representatives.

Terry Morrow (D) announced that he would be resigning his seat, which he won re-election to on November 6, 2012, on January 7, 2013. A Democratic primary was held on January 29. While two Republicans were running, Allen Quist was chosen by a GOP convention and Jim Golgart suspended his campaign, leaving Quist without a primary opponent.[58] [62][63] On the Democratic side, Clark Johnson was endorsed by the party convention, but due to the late timing of the convention, all four candidates were in the primary on January 29, which Johnson won.[64][65] The special election was held on February 12, which Johnson won.[66]
