The ballot language read as follows:[2]

Shall Town of Telluride taxes be increased $834,044 in 2010 (the first full fiscal year of the tax increase) and by such amounts as may be generated annually thereafter through the imposition of an additional mill levy of not more than three (3) mills to be deposited in the towns street and alley fund and to be utilized solely to finance the costs of acquiring, constructing, installing and maintaining the town's streets, alleys and other public right-of-ways and all necessary and related facilities; and shall the proceeds of such taxes and investment income thereon be collected, retained and spent by the town as a voter-approved revenue change in 2010 and in each year thereafter, without regard to any spending, revenue-raising or other limitation contained within Article X, Section 20 of the Colorado Constitution, the property tax revenue limitation of Section 29-1-301, Colorado Revised Statutes, or any other law?
