An effort to recall Victor Gomez and Doug Emerson from their positions on the Hollister City Council in Hollister, California was announced in March 2010.[1] At the time, Gomez was Hollister's mayor and Emerson a member of the City Council. The recall effort was ultimately abandoned.

Background

Scott McPhail was behind the recall effort. McPhail is the owner of the Purple Cross RX, a marijuana dispensary ("pot shop") in Hollister.[2]

McPhail's interest in recalling Gomez and Emerson springs from the fact that the City of Hollister has erected a number of barriers to McPhail's ability to run and operate his Purple Cross RX.[1] One of the main obstacles revolves around whether it is consistent with Hollister's zoning laws for the Purple Cross RX to be located at 335 San Benito St., two floors above The Ink Shop tattoo parlor. That area of Hollister is commercially-zoned. McPhail's marijuana dispensary is legally organized as a non-profit and the city contends that the business cannot situate itself in a commercially-zoned area of town.

Gomez was elected to the position of mayor in 2009. He said he is not worried about the recall effort.

If the recall effort had succeeded at forcing a vote, the election would have been administered by San Benito County election officials.
