Washington GOP and Libertarians ordered to repay state on Initiative 872

SEATTLE, Washington: Western District of Washington federal judge John Coughenour ordered the Washington State Republican and Libertarian parties to repay the state of Washington legal costs involving their lawsuit on Washington I-872.[1]

The decision to order the Republicans and Libertarians to repay came after the U.S. Supreme Court in 2009 determined the Top Two primary system was constitutional after the Western District of Washington and Ninth Circuit Court of Appeals ruled the system unconstitutional. The original lawsuit against I-872 was brought by the Democratic, Republican and Libertarian Parties, but the Democratic Party had already repaid its part of the legal fees by the time Judge Coughenour wrote his order to compel repayment.[1]

The Washington Republican Party is ordered to repay $55,097 in legal fees while the Libertarian Party of Washington is ordered to pay $16,301.[1]
