The Tuesday Count, up by one, is at 75 ballot measures in 28 states for the 2010 ballot. But with four measures pending signature verification and a few others waiting for legislative action and court rulings, the Tuesday Count is likely to face some changes in the next couple of weeks. In the ten even-numbered years from 1990-2008, an average of 211 ballot questions made it onto statewide ballots, with a low in 2004 of 162 and a high in 1998 of 272. If 2010 results in an average year, anywhere from 130 to 140 additional measures can be expected to qualify for the ballot.

This week the Alaska election office certified 36,285 submitted signatures for the Alaska Parental Notification Initiative, however, before proceeding to the August 24, 2010 primary election ballot the legislature has the opportunity to act on the measure. The measure is also pending a court ruling on the current ballot language. The Maine Oxford Casino Initiative remains pending legislative action. Should the Maine Legislature chose not to act on the measure, it will appear on the November 2, 2010 statewide ballot.

March 18 marks the deadline for additional signatures to qualify the Colorado Fetal Personhood Amendment for the November 2, 2010 statewide ballot. The California Marijuana Legalization Initiative and the South Dakota Medical Marijuana Act remain pending signature verification. The Ohio Slot Machines Veto Referendum is currently in a legal dispute with the secretary of state after she began an investigation of campaign supporters' finance reports. Signature verification also remains for the Ohio measure.
