Garcia won election in the 2013 election for New Jersey General Assembly District 33. Garcia was bracketed with Raj Mukherji and defeated John Hilt IV, Anthony Mills and Peter Basso in the June 4 Democratic primary. He and Raj Mukherji (D) defeated Jude Anthony Tiscornia (R) and Armando Hernandez (R) in the general election which took place on November 5, 2013.[4] [5][6][7]

Garcia was disqualified before the primary by Assignment Judge Peter Bariso for leading an agency that receives federal funds. Garcia appealed the ruling and it was overturned by an appellate court, placing Garcia back on the ballot.[8]
