Fleming lost to Republican incumbent Milo Smith by a margin of 10,196 to 4,607. Libertarian candidate Ed Dilts came in third with 603 votes.  The general election took place on November 2, 2010.
In the May 4th primary, Fleming ran unopposed and received 1,090 votes.
