An effort to recall Kelly Spratt from her position as McIntosh County Commission Chairwoman was judicially invalidated in January 2012.[1] Spratt was elected in 2010. The recall effort was initiated by a group of citizens in December 2011.

Background

Dana Dalby and Aronica Henry were co-chairs of the recall committee. The recall petition alleged that Spratt was guilty of failure to perform duties prescribed by law, repeated acts of misconduct, malfeasance in office, and violation of her oath of office and state sunshine laws. Recall organizers were unhappy with a contract that the McIntosh County Commission had entered into with Waste Management Co. to provide curb-side trash pick up services to county residents.[1]

Path to the ballot

In December 2011, recall supporters turned in 128 signatures on their recall application. 100 signatures were required.

In January 2012, Superior Court Judge Louisa Abbot ruled that the recall application was insufficient, saying "There’s been no showing that there’s been any illegality whatsoever."[2]

If the recall had been allowed to move forward, recall organizers would have needed to collect signatures from 30% of the county's voters.[1] That would have amounted to 2,426 signatures.
