This page details Maryland signature requirements. In many states, the signatures of registered voters must be collected to place candidates or initiatives on the ballot. However, for candidates, filing fees are sometimes required or accepted in lieu of signatures.

Federal offices

U.S. Senate

Partisan candidates for Senate must pay a $290.00 filing fee.[1] Write-in candidates do not have to pay a filing fee. However, write-in candidates must submit a certificate of candidacy by the Wednesday before the election.[2] Green and Libertarian candidates must file a Declaration of Intent, Statement of Organization, Financial Disclosure Statement, Certificate of Nomination, Certificate of Candidacy and $290.000 filing fee.[3] Candidates wishing to get on the ballot via petition must get the allocated number of signatures for nominating petitions.[4]

U.S. House

Partisan candidates wishing to appear on the primary ballot for Senate and House had to file with the Maryland Secretary of State by January 11, 2012.[5]

Green and Libertarian candidates for Senate had to file a Declaration of Intent by June 29, 2012 and Statement of Organization, Financial Disclosure Statement, Certificate of Nomination, Certificate of Candidacy and $290.000 filing fee by August 6, 2012.[6] Green and Libertarian candidates for House had to file a Declaration of Intent by June 29, 2012 and Statement of Organization, Financial Disclosure Statement, Certificate of Nomination, Certificate of Candidacy and $100.000 filing fee by August 6, 2012.[7]

Ballot measures

Maryland signature requirements are calculated based on the number of votes cast for Office of Governor in the previous election. Only veto referendums are permitted in Maryland; there are no provisions for initiated constitutional amendments or statutory initiatives.

Signature requirements

For a referendum on a statewide law: signatures must equal 3% of votes cast for governor in the most recent election. For a referendum on a local law, signatures must equal 10% of votes for governor in the affected jurisdiction.

Deadlines

The deadline to submit the first third of signatures for a veto referendum in Maryland is 40 days after the legislation is signed into law[10]

Geographic distribution

  • There is a distribution requirement for signatures on statewide petitions: No more than half of required signatures may be from any one county or the City of Baltimore.
