The Judicial Taxation Ban did not appear on the November 4, 2008 statewide ballot in Missouri as a legislatively-referred constitutional amendment. The proposal would have prohibited judges from imposing, restricting or raising taxes. In addition to banning court-ordered taxes, the initiative would have also prohibited state courts form ordering lawmakers or governmental agencies to spend money except as approved by legislation or a vote of the people.
The measure was sponsored by the Republicans and had been vocally opposed by the democrats. The House sponsored a similar bill last year by a 91-60 vote, but the measure never cleared the Senate.
