The mission statement of the board is as follows:

The Board of Public Utilities is established by Title 48, Section 2-1 of the New Jersey State Statutes:[3]

In order to serve on the board a citizen must "devote their entire time to the duties of the board and shall not engage in any occupation, profession or other gainful employment."[3]

Per Title 48:2–1 of the New Jersey Statutes the members of the board are appointed to six-year terms by the governor with the advice and consent of the Senate. No more than three members may be members of the same political party.[3]

In the event of a vacancy the Governor, with the advice and consent of the Senate, makes an appointment for the rest of the unexpired term.[3]
