Ballot summary
The ballot title read as follows:[1]
Requires minimum incarceration for any felony committed by person with two or more felony convictions.
Result of "Yes" Vote: "Yes" vote creates mandatory minimum incarceration of three to 12 years for any felony committed by a person with two or more previous felony convictions.
Result of "No" Vote: "No" vote retains: presumptive prison terms based on particular felony, offender's history; courts' ability to depart from presumptive term; mandatory minimum terms for some felonies.
Summary: Current law requires felony prison terms of presumptive lengths based on particular crime and on offender's history, while permitting upward or downward departure for substantial, compelling reasons; also requires 70 to 300-month minimum prison terms for certain felonies, life sentence for aggravated murder or third sex-crime conviction, five to 30-year minimum for using firearm during crime. Measure creates mandatory minimum prison term for any new felony (12-year minimum for Class A felony, six years for Class B, three years for Class C) for person with two or more previous felony convictions; does not replace, reduce longer sentences that may be imposed; previous felony convictions include convictions in other jurisdictions, convictions in same sentencing proceeding based on separate criminal episode. According to the secretary of state, supporters did not file signatures in an attempt to qualify the measure for the 2010 ballot. Initiative petitions for statutes required six percent of 1,379,475, or 82,769 signatures. The deadline for filing signatures for the November 2, 2010 ballot was July 2, 2010.
