The Texas Education Agency is comprised of the commissioner of education and the agency staff, which, along with the State Board of Education's 15 members, guide and monitor activities and programs related to public education in Texas, according to the state's constitution.

Agency Staff

The Commissioner of Education, who leads the Texas Education Agency, is appointed by the Governor and his or her term coincides with the governor's four year term.

Agency roles and duty

The T.E.A administers and monitors compliance with state and federally mandated education programs, including the funding. It conducts research, analysis, and reporting to improve teaching and learning. The agency also conducts hearings involving state school law as the Commissioner of Education sees fit, under his or her supervision.

The T.E.A establishes and implements pilot programs, carries out duties relating to the investment capital fund, and develops and implements a teacher recruitment program all in the effort to carry out duties under the Texas Advanced Placement Incentive Program.

The agency has powers and duties relating to adult and community education and must develop a program of instruction in driver education and traffic safety. The T.E.A is also in charge of programs concerning children with visual impairments and regional day school programs for the deaf.

It is supposed to establish and maintain an electronic information transfer system, maintain and expand telecommunications capabilities of school districts and regional education service centers, and establish technology demonstration programs.

The agency reviews school district budgets, audit reports, and other fiscal reports and prescribes forms for financial reports made by or for school districts to the commissioner or the agency.

The agency cooperates with the Texas Higher Education Coordinating Board in connection with the Texas partnership and scholarship program.

The agency can enter into an agreement with a federal agency concerning a project related to education, including the provision of school lunches and the construction of school buildings. By the time the 30th day before the date the agency enters into an agreement concerning a new project or reauthorizing a project rolls around, the agency must provide written notice, including a description of the project, to:

  • The governor;
  • The Legislative Budget Board; and
  • The presiding officers of the standing committees of the senate and of the house of representatives with primary jurisdiction over the agency.[1]

Expiration

The T.E.A. statutes were added to the Texas legislation in 1995 and will expire on September 1, 2012.

Relation to independent school districts

The investment capital fund is money transferred to the fund set out in Texas Statutes and the agency administers the fund. The fund assists eligible public schools to implement practices and procedures consistent deregulation and school restructuring so that student achievement would improve and schools would identify and train parents and community leaders who will hold the school and the school district accountable for achieving high academic standards.[1]
