Two related ballot measures, the Litter Control Act, Initiative 40 and the Litter Control Act, Referral 40B, were on the November 7, 1972 general election ballot in Washington as an Initiative to the Legislature, and a competing measure referred by the legislature.

Irving B. Stimpson, Secretary of the Washington Committee to Stop Litter, filed the language for the initiative on August 20, 1970. His group turned in 141,228 signatures on December 30, 1970. The measure was certified to the Washington State Legislature on January 29, 1971.

The legislature declined to adopt Initiative 40 and, instead, decided to refer a similar measure to the ballot, Referral 40B. The alternative measure 40B, was victorious.

The votes cast on November 7 were:

  • For Either: 788,151
  • Against Both: 418,764
  • Prefer Initiative 40: 194,128 Defeatedd
  • Prefer Referral 40B: 798,931 Approveda
