Role in the initiative process
There are several steps that the secretary of state requires be followed to file for an initiative to be on the ballot.
The first is to file the bill along with an application and a fee of $500. There are various restrictions and requirements that must be followed. The secretary of state then issues the Official Petition form and circulation can begin. The petitioners then have 18 months to gather signatures that must equal 15% of total votes in the previous general election and 15% of the votes in 2/3rds of the counties in Wyoming. Unlike some states, no one may be paid for the number of signatures collected. (See Wyoming signature requirements).
Within 60 days of the filing the secretary of state will notify the petitioners if the initiative has enough signatures to go on the ballot. If the measure is placed on the ballot and receives more than 50% of the total statewide votes cast in that election, then it passes and becomes law after 90 days. Note: A ballot measure may get more "yes" votes than "no" votes and still fail. In order to pass, it must get at least 50% of the total statewide votes cast in that election.
