The Georgia 4th Superior Court District resides in Georgia. This district is divided into the DeKalb Judicial Circuit and the Rockdale Judicial Circuit. Ballotpedia's coverage scope only includes the DeKalb Judicial Circuit. The DeKalb Judicial Circuit was known as the Stone Mountain Judicial Circuit until January 1, 2025.[1]

Jurisdiction

This court holds the following jurisdiction:[2]

The Superior Courts of Georgia is a court of general jurisdiction handling both civil and criminal law actions. Superior Court Judges preside over cases involving misdemeanors, contract disputes, premises liability, and various other actions. In addition, the Superior Court has exclusive equity jurisdiction over all cases of divorce, title to land, and felonies involving jury trials, including death penalty cases.[3]

There are 202 judges on the Georgia Superior Courts, each chosen by the people in nonpartisan elections to serve a four-year term.

The process for selecting a chief judge and that chief judge's term varies by circuit.[4]

Qualifications
To serve on this court, a judge must be:

  • a state resident for three years;
  • a resident of the circuit he or she is representing;
  • admitted to practice law for at least seven years; and
  • at least 30 years old.

Primary election

Most court elections in Georgia are nonpartisan. Counties may choose to hold partisan elections for probate court positions. There are only judicial primaries for partisan elections.[5][6]

Runoff election

If no candidate receives a majority of the votes in the election (at least 50%+1 of the vote), a runoff election will be held between the two candidates with the most votes.[7]
