A.P. Fuller was a South Dakota Circuit court judge for the Seventh Judicial Circuit.[1]

Removal from office

In April 2011, the South Dakota Judicial Qualifications Commission found that Fuller was "rude and made racist remarks in court," recommending that he be removed from judicial service. Offenses included making an obscene gesture (giving "the bird") to a lawyer in his courtroom.[2] Fuller had been suspended from duty with pay since October of 2010.[3] On May 18, 2011, the South Dakota Supreme Court authored an opinion which ruled that Fuller should be removed from office. The ruling read in part: "This is the first time in its 121-year history that this Court has been called upon to render judicial discipline of this severity upon one of the judges of this State. We hope this Court's words do not go unheeded and will result in a judicial future free of this type of misconduct".[4][5]
