Senate Bill 83 was a bill introduced to the Alabama State Senate by Sen. Kim Benefield on January 12, 2010. The bill passed the Alabama State Senate on April 14, 2010, and was sent to the Alabama House of Representatives the same day. It was under review by the Agriculture and Forestry Committee, and ultimately died in committee.
If passed, the bill would have prohibited a county or municipality from passing legislation pertaining to fertilizers, as that is within the state Department of Agriculture and Industries jurisdiction. Certain exemptions do exist and when those exemptions are claimed a county or municipality must document the rationale behind claiming the exemption and any information pertinent to the case, which would then become public record.[1]
