Appeals court throws out El Paso recall

EL PASO, Texas: On February 17th, the Texas Eighth District Court of Appeals unanimously ruled that an El Paso group seeking the recall of mayor John Cook had violated election law during the recall petition drive. The court ordered that the recall election, scheduled for April 14th of this year, should not be held.[1] Pastor Tom Brown of the Word of Life Church spearheaded the recall effort against Cook and El Paso city council members Steve Ortega and Susie Byrd in 2011 after the city council voted to return health benefits to same-sex partners of city employees.[2] A voter-approved ordinance had stripped benefits from same-sex partners. Cook had been attempting to stop the recall for several months. In November 2011, Judge Javier Alvarez rejected Cook's request for an injunction.[3]
