Arkansas Supreme Court upholds ruling on anonymous lawsuit
April 5, 2010
Arkansas: The Arkansas Supreme Court has released an opinion upholding the ruling of a Benton County Circuit Court that bars undocumented aliens from filing anonymous lawsuits. The lawsuit was filed by "Jane Doe" who was unable to renew her driver's license because she could not produce proof of her lawful immigration status and then was dismissed after the plaintiffs did not identify themselves within 30 days. The Supreme Court opinion was issued after the family of undocumented aliens appealed to the court saying that they should have been allowed to proceed with there case anonymously. Justice Paul Danielson wrote in the opinion saying, "After considering the various cases from the federal courts, we feel certain that status as an undocumented immigrant alone is not enough to permit a party to proceed anonymously."[1]
