The Attorney General of Guam is an elected state officer who serves as the attorney and chief legal officer for the territory of Guam.[1]

The attorney general is responsible for overseeing the Guam Department of Law, acting as the public prosecutor on behalf of the Guam government, and protecting the rights and properties of the Guam government. The attorney general also issues formal legal opinions at the request of various public officials.[1]

Current officeholder

The current Attorney General of Guam is Douglas Moylan (nonpartisan). Moylan assumed office in 2023.

Authority

The office of attorney general is established in 5 GCA, Division 3, Chapter 30 §30101(a) and 48 U.S. Code § 1421g(d)(1).

5 GCA, Division 3, Chapter 30 §30101(a)

The Office of the Attorney General of the government of Guam shall be administered by the Attorney General of Guam, who shall be elected by the people of Guam for a term of four (4) years.

The Attorney General of Guam shall be the Chief Legal Officer of the Government of Guam.

Qualifications

Per 5 GCA, Division 3, Chapter 30 §30101(b), the attorney general must be:

  1. at least 30 years old;
  2. a U.S. citizen and a Guam resident;
  3. an active member in good standing of the Guam Bar Association for at least five years preceding his or her candidacy; or
  4. an inactive member of the Guam Bar Association who, in the five years preceding his or her candidacy, served as an elected official, public auditor, supreme court justice, or superior court judge in Guam.[1]

The attorney general must not have been:

  1. a convicted felon;
  2. suspended from practicing law for ethics violations.[1]

Elections

Guam elects its attorney general in federal midterm election years (e.g. 2018, 2022, 2026, 2030, etc.). The attorney general inauguration is always set for the first Monday in the January following an election. Thus, January 5, 2015, and January 7, 2019, were inaugural days.[1]

Vacancies

A vacancy in the position of attorney general can be filled in two ways:

  1. The governor appoints a replacement if the vacancy occurs less than six months before a general election for the office of attorney general; or
  2. A special election is held at least three months after the vacancy occurs but no later than six months before a general election for the office of attorney general. In this case, the governor appoints a replacement pending the results of the special election.[1]

Duties

Per 5 GCA, Division 3, Chapter 30 §30109, the attorney general is responsible for:

  • acting as the public prosecutor for Guam.
  • conducting all civil actions on behalf of the government of Guam.
  • delivering receipts of money or property received in his or her official capacity.
  • protecting the rights and properties of the government of Guam.
  • preparing and submitting annual budgets.[1]

Compensation

Per 5 GCA, Division 3, Chapter 30 §30116, the attorney general receives an annual salary based on 90% of the annual compensation for a judge of the Superior Court of Guam.[1]
