Attorney who sued judge to run for judge's position

Judge Phillips has announced his retirement, saying "A job of district judge is very wearing, and I’m worn out. I feel like I’m still at the peak of my capacity, so it really is the best thing for the citizens of the district that I leave at the top of my game."[2]
Britt Long will compete against Jon Oldenburg for Phillip's position.[2]

BILLINGS, Montana: Attorney Britt Long has filed to run for the 10th District Court in the 2012 elections.[3] The position she seeks is currently held by Judge E. Wayne Phillips who happens to be the judge Long filed suit against last September. Long sought compensatory and punitive damages for assault due to an incident when Judge Phillips allegedly slapped her in the buttocks with a legal file. Long said she suffered from "extreme personal stress and embarrassment, anxiety, stress, interrupted sleep, elevated blood pressure, heart palpitations and other symptoms associated with extreme anxiety." The suit sought compensation for medical expenses and lost wages.[4] Attorney Long said she will drop the suit if Judge Phillips does not run for re-election.[3]
The 2012 Montana judicial elections consist of a primary on June 5th and general election on November 6th.[5][6] The 10th District Court presides over Fergus, Petroleum and Judith Basin counties.
