The Bernalillo County Metropolitan Court resides in New Mexico. The court was established in 1980 to combine the jurisdiction of the Albuquerque Municipal Court, Bernalillo County Magistrate Court, and the Bernalillo County Small Claims Court.[1]

Jurisdiction

This court holds the following jurisdiction:[2]

Nineteen judges preside. This is a court of limited jurisdiction. Jury trials.

This court will hear these types of cases: Tort, contract, landlord/tenant rights ($0-10,000); Felony first appearances; Misdemeanor, DWI/DUI, Domestic Violence and other traffic violations.[3]

Judges of the Bernalillo County Metropolitan Court are each appointed to four-year terms by the governor.[4] After this initial term, judges stand in retention elections. To serve on this court, a judge must be a member of the state bar and have three years of law practice in New Mexico.[5]

New Mexico is one of eight states that use partisan elections to initially select judges and then use retention elections to determine whether judges should remain on the bench. To read more about how states use judicial elections to select judges across the country, click here.

Retention election

In these elections, judges do not compete against another candidate, but voters are given a "yes" or "no" choice whether to keep the judge in office for another term. The retention elections are held on general election day. In a retention election, a candidate must receive 57% of the vote to be retained.[6]
