A recall election to remove Bob Hilb from the Canyon Ranch Sanitary District governing board was held on November 5, 2019.[1] The recall effort began in 2019, with supporters citing issues with a wastewater treatment facility and a lawsuit over who pays for its maintenance.[1] Hilb removed himself from the ballot prior to the fall 2019 candidate withdrawal date, leaving candidates Jerry DeSantis and Jeff McLeod to vie for the position. DeSantis defeated McLeod with 55.65% of the total votes cast.[2]

Election

The election was held by mail-in ballot. Candidate Jerry DeSantis won the election. DeSantis received 374 votes (55.65%) and candidate Jeff McLeod received 298 votes (44.35%).[2]

Recall supporters

Supporters of the recall effort released the following statement.

When Bob Hilb was elected to the Inscription Canyon Ranch Sanitary District (ICRSD) Board in June 2011, agreements were in place that required wastewater treatment facilities for properties annexed into the ICRSD (i.e. properties outside of the Inscription Canyon Ranch subdivision) to be funded by their respective developers. However, as chairman of the ICRSD Board, Bob Hilb negotiated an Amended and Restated Development Agreement (dated 01 Mar 2012) which relieved the developers of most of their responsibility to fund wastewater treatment facilities for their properties. The agreement gave away the District's State of Arizona authority to charge connection fees for all future connections from within the developer's communities thereby prohibiting

the District from raising the necessary capital for future plant expansions. In addition, he agreed to a provision that the District must accept and approve all connection requests submitted by developers regardless of accuracy. As a result of these actions, all ICRSD residents will bear the burden of the very high future costs for all required plant expansions. We ask that the ICRSD residents recall Bob Hilb.[3]

Recall opponents

In response to recall supporters, Hilb released the following statement.

The "facts" supporting allegations in the recall petition are incorrect. Agreements between the District and the Developers from 2000 - 2006 provided that the Developer would advance funds to build a new wastewater treatment plant in phases to meet the District's needs and lot sale fees were instituted to provide funding for further plant expansions when needed. In 2012, I was involved in negotiating an amended agreement between the District and the Developers to end a costly and losing legal battle resulting from unlawful actions taken by prior Board members who were recalled by the voters. The amended agreement provided for future plant expansion funding from increased lot sale fees (in lieu of connection fees) and $150,000 from the Developers. The District has adequate funds to pay for expansions to double the plant capacity. Longer term (10-20 years) needs will be funded from future lot sales fees and a growing customer base. Documents to verify these facts are at www.icrsd.net/documents-reports.html. Too much money has been wasted by prior Boards' fights with the Developers. Vote for a director who will focus on the District's mission to provide wastewater treatment services to its constituents in a cost effective and environmentally sound manner.[3]
