Charter governing election timing
State law requires Idaho school districts to hold general elections in November of odd-numbered years, with a primary election in May if the district holds a primary.[1]
Elections for the Boise School District Board of Trustees, however, are governed by the district's charter and are exempt from state law. The district charter states that board of trustee elections occur every two years on the first Tuesday in September of even-numbered years.[2]
The district charter also mandates six-year board member terms with elections staggered so that as close to one-third (either two or three) of the seven trustees are up for regular election every two years. State law sets four-year terms for the trustees of other school districts, with as close to half of board members up for regular election every two years.[1][2]
The district's charter was approved by Idaho's territorial government in 1881, nine years before Idaho became a state. The charter has been amended by the state legislature but remains in effect. In addition to setting unique election rules for the Boise School District, the charter allows the board of trustees discretion over the district's budget; the regulation of schools and the length of school terms; the determination of tuition for nonresident students; the employment and salaries of a superintendent, teachers, and school staff; and the determination of textbooks and curricula.[3]
