Brian R. Merrick was the first justice of the Orleans District Court in Barnstable County, Massachusetts.[1] He was appointed to the bench in 1989 by former Governor Michael S. Dukakis.[2] His term expired on May 9, 2014, when he reached the mandatory retirement age of 70.[3][4][5]

Noteworthy events

Public reprimand for conducting legally insufficient plea hearings (2012)

On August 31, 2012, the Massachusetts Commission on Judicial Conduct issued a public reprimand of Judge Brian R. Merrick. While sitting on the Orleans District Court, the commission found that Merrick did not follow procedural requirements when he accepted pleas from defendants who were charged with minor criminal motor vehicle offenses. According to the commission, Judge Merrick acknowledged he was not conducting plea hearings in a proper legal manner, but said he now conducts these hearings in accordance with the law.[6]
