An effort to recall Bryan Miranda from his position on the city council of New Braunfels, Texas was abandoned in January 2012 after recall petitions were rejected by the city council.[1] The city council announced that there would be no recall election unless recall organizers take their case to court.[2] Miranda represents District 5.
Reasons for recall
David Martinez of the League of United Latin American Citizens submitted the petition. Recall organizers were unhappy that Miranda had voted to ban disposable containers on the Comal and Guadalupe rivers inside the city limits.[3] Recall supporters alleged misconduct and incompetence by Miranda.
Path to the ballot
On December 31st, 2011, recall organizers submitted the required 150 signatures to the city council for verification. The city council voted to reject the signatures on the grounds that the reasons for recall were "baseless" and "frivolous." The legality of this move is disputed, as the city charter stipulates that the city council has a duty to call a recall election if enough valid signatures are submitted.[4] Recall organizers have not yet announced if they will file a legal challenge.[2]
Legal investigation
In January 2012, the New Braunfels Police Department launched an investigation into potential petition fraud and forgery. This action came after a resident signed a sworn affidavit claiming that he had not signed the recall petition, despite the fact that his signature appears on the petition.[5] City officials say signatures were forged on the recall petitions for Miranda and mayor Gale Pospisil. Leonidas Patrick “Mark” McGonigal, a supporter of both recall campaigns, was charged with aggravated perjury in February 2012.[6]
