The ballot measure would have removed the exception for involuntary servitude as a punishment for crime, thereby prohibiting slavery and involuntary servitude in all circumstances.[1]

The measure would have amended Section 6 of Article I of the California Constitution. The following struck-through text would have been deleted and underlined text would have been added:[1]

SEC. 6. Slavery is prohibited. Involuntary servitude is prohibited except to punish crime. and involuntary servitude are prohibited.[2]

In California, a two-thirds vote is needed in each chamber of the California State Legislature to refer a constitutional amendment to the ballot for voter consideration.

The constitutional amendment was introduced on December 18, 2020, as Assembly Constitutional Amendment 3 (ACA 3). On March 21, 2022, the California State Assembly passed ACA 3 in a unanimous vote of 59-0 with 17 assembly members absent. The amendment did not pass before the June 30, 2022, deadline.[1]
